Terms of Service

These terms are an agreement between you and João Henrique Costa Araujo, a sole proprietor in British Columbia, Canada, who runs Etude ("Etude", "we", "us"). Contact: hello@etude.study.

They cover the online services: the website at etude.study, Etude accounts, Etude Sync, and buying or selling decks on the paid Market. The Etude app itself is free, open-source software under the MIT License. You can use the app without an account and without agreeing to these terms; the MIT License is what governs the software.

1. Who can use the services

You need to be at least 13 years old. If you're under the age of majority where you live, you need a parent or guardian's permission to buy anything, and they're responsible for those purchases.

2. Your account

  • You sign in with a link sent to your email or with a passkey. There is no login password.
  • Keep your email account and devices secure. Anything done through a signed-in device counts as done by you. You can see and revoke your devices in Settings.
  • One person per account. Don't create accounts in bulk or to get around a suspension.
  • You can delete your account at any time from inside the app (Settings → Account → Delete account). What happens to your data is in the Privacy Policy.

3. Etude Sync

Etude Sync keeps your collection in step across your devices.

  • End-to-end encryption. Your collection is encrypted on your device before it's uploaded, with a key that we never receive. We store data we can't read.
  • Your Sync password and recovery key are your responsibility. We can't reset them, and we can't recover your synced data without one of them. If you lose both, the copy on our server is unreadable for good. The copies on your devices are not affected.
  • Price. US$5 per month or US$40 per year, plus any tax, with 1 GB of storage per account. Prices can change; we'll tell you by email at least 30 days before a change affects your renewal.
  • Payments are handled by Polar (Polar Software Inc.), which acts as the merchant of record: Polar sells you the subscription, charges your card, collects tax and issues your receipt, under its own terms and privacy policy. Etude never sees your card number.
  • Renewal and cancellation. Subscriptions renew automatically until you cancel. You can cancel at any time from the customer portal linked in Settings; Sync keeps working until the end of the period you've paid for. If a payment fails, Sync keeps working for a 7-day grace period, then pauses. Pausing or ending Sync never deletes anything on your devices.
  • After Sync ends, we keep your encrypted data for 90 days so you can resubscribe without uploading again, then delete it.
  • Storage limit. When you reach your quota, new uploads stop until you free space. Nothing already stored is deleted.
  • Refunds are covered in the Refund Policy.

4. The Market

The free Market is a public catalogue of decks, card types and themes hosted on GitHub. Each entry is published by its author under the license stated in it.

The paid Market lets independent creators sell decks:

  • Etude is the seller. When you buy a paid deck, you buy it from Etude, which collects payment and applicable tax and pays the creator their share. Payments are processed by Stripe.
  • The creator made the deck, and remains responsible for its content and accuracy. We review every paid deck before it goes on sale (rights, minimum quality, an honest preview), but a review is not a guarantee that a deck is free of errors.
  • What you get. A personal, non-transferable license to use the deck in Etude on your own devices, including its future updates for as long as the creator keeps publishing them. You may not resell, share or republish it.
  • Availability. The paid Market is currently available to buyers in Canada and the United States. Purchases from elsewhere are refunded in full.
  • Creators agree to the separate Creator Terms.

5. What you can't do

Don't use the services to:

  • break the law, or infringe someone else's copyright, trademark or privacy (including uploading or selling decks made from material you don't have the rights to, such as copied textbooks or leaked exam questions);
  • distribute malware or card types designed to harm users or their devices;
  • attack, overload, probe or reverse the services' security, or get around rate limits, quotas, payment or region checks;
  • access other people's accounts or data;
  • resell or share access to Sync or paid decks.

We may remove content or suspend accounts that break these rules. Where it's reasonable, we'll tell you why and give you a chance to respond first.

6. Your content

Your decks, cards, reviews and media are yours. Because Sync is end-to-end encrypted, we can't read them and claim no rights to them.

For decks you publish to the Market, you grant Etude a worldwide, non-exclusive license to host, copy, display, review and distribute them to users for as long as they're listed (and, for paid decks, to buyers who already bought them, after that). Creator Terms say more.

7. AI features

Some Etude features (AI grading, Ask Etude, Edit for me) send the content involved to the AI provider you configure, such as OpenAI or OpenRouter, directly from your device and under your own account with that provider. OpenRouter passes it on to the company that runs the model you picked. Etude does not receive that content. The provider's terms apply, and AI output can be wrong.

8. Open source and third-party services

The Etude app and the etude-cloud server are open source. You're free to run your own sync server; these terms apply only to the services we run. Links to other sites (GitHub, YouTube, Ko-fi) are governed by those sites' own terms.

9. Changes and ending the service

  • We may change these terms. For material changes we'll email account holders at least 30 days before they take effect. Continuing to use the services after that means you accept the new terms.
  • We may change or stop offering a service. If we stop Etude Sync, we'll give at least 60 days' notice and refund any prepaid time you haven't used. The app keeps working offline without it.
  • You can stop using the services at any time.

10. Disclaimers

The services are provided "as is" and "as available". We work to keep them running and your data safe, but we don't promise they'll be uninterrupted or error-free. Keep your own copies of anything important; the app can export your collection at any time.

Etude is a study tool. Content in decks (including medical, legal or exam material) is not professional advice.

11. Limitation of liability

To the extent the law allows, Etude's total liability to you for any claim about the services is limited to the greater of the amount you paid Etude in the 12 months before the claim, or US$50. We aren't liable for indirect or consequential losses, such as lost profits or lost study time. Nothing in these terms limits liability that can't be limited by law, or your rights as a consumer under the law where you live.

12. Law and disputes

These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. Disputes go to the courts of British Columbia, unless the consumer protection law where you live gives you the right to use your local courts. Before taking any formal step, please write to us; most problems get solved by email.
