Legal creator terms
Creator Terms (paid Market)
These terms apply when you sell decks on Etude's paid Market. They add to the Terms of Service.
1. Who can sell
- You need an Etude account and a Stripe Express account, which you set up through Stripe during onboarding. Stripe verifies your identity and bank details; Etude never sees your documents. Stripe's Connected Account Agreement applies between you and Stripe.
- Payouts are currently available to creators in the United States, Canada, the United Kingdom, the European Economic Area and Switzerland, because of Stripe's cross-border payout rules. Other countries will follow when that changes.
2. Listing a deck
- You set the price, from a minimum of US$5.
- Every deck is reviewed before it goes on sale and when you publish a major update. We check that you have the rights to the content, that the deck works in Etude, that it meets a minimum quality bar, and that its description and preview are honest. We may ask for changes or decline a deck, and we'll tell you why.
- You may sell a deck elsewhere too. Etude doesn't ask for exclusivity.
3. Money
- Etude's fee is 20% of the price, before tax. You receive the remaining 80%, less Stripe's processing costs as shown in your dashboard. Example: on a US$10 deck you receive US$8 before processing.
- Tax. Etude is the seller to the buyer, so Etude calculates, collects and remits sales tax, GST/HST and VAT on paid Market sales. Tax collected never counts toward your share. You remain responsible for your own income tax.
- Payouts are monthly, once your balance reaches US$25, through Stripe to your bank.
- Refunds and chargebacks. When a buyer is refunded under the Refund Policy, your share of that sale is reversed. If a chargeback is lost, your share is reversed and the dispute fee is shared in proportion to the split.
- We may change the fee or minimum price with 30 days' email notice. Sales made before the change keep the old terms.
4. Your content and rights
- You keep ownership of your decks.
- You confirm that you have the right to sell everything in them: text, images, audio, card types and data. Decks made from copyrighted textbooks, question banks, leaked or confidential exam material, or someone else's deck without permission are not allowed.
- You grant Etude a worldwide, non-exclusive license to host, review, copy, display a preview of, and distribute your deck to buyers, and to keep it available to people who bought it even after you stop selling it.
- Buyers get a personal, non-transferable license to use the deck in Etude, including its updates while you publish them.
5. Updates and support
- Keep your decks working and accurate. Fix reported errors within a reasonable time.
- Updates reach existing buyers at no charge.
- If a deck stops working or turns out to infringe someone's rights, we may pause sales, refund buyers and reverse your share for those sales.
6. Takedowns
If someone reports that your deck infringes their rights, we may pause it while we look into it, and we'll share the report with you so you can respond. Repeated infringement ends your ability to sell.
7. Ending
You can stop selling at any time by unlisting your decks; buyers keep access. We can end these terms with 30 days' notice, or immediately for fraud, infringement or a serious breach. Balances owed to you are still paid out, minus reversals.
